Terms and Conditions - Cancellation Policy

  • To secure and confirm your reservation for our services, we require a 20% booking deposit. The outstanding balance is due on the day of the service and can be settled using cash, credit, or debit. Please note that a 4% processing fee applies to the remaining balance if paid by card.
    Please note that our exchange rates are based on our bank's rate. Keep in mind that your bank may apply higher exchange rates when converting from USD to Mexican pesos.
     

  • Cancellation of a booked charter is subject to the following conditions:
    •    Cancellations made at least 72 hours prior to the scheduled service date will receive a full refund of the deposit.
    •    No refunds will be provided for cancellations made less than 72 hours before the scheduled service.
    •    The deposit is fully refundable in case of bad weather, based on the local authorities' harbor master port closure.

  • The safety of our guests is our top priority. In the event of adverse weather conditions or circumstances beyond our control, we reserve the right to cancel or reschedule a charter for the safety of all parties involved. In such cases, a full refund or rescheduling options will be provided.

  • Guests are expected to adhere to safety guidelines provided by the crew during the charter. Any damage to the vessel or its equipment resulting from negligence or misconduct of guests will be the responsibility of the guest. Crew members reserve the right to cancel the charter in the event of negligence, abuse towards other guests, or the crew.

  • The consumption of alcohol is allowed in moderation. Alcohol consumption is strictly prohibited before the completion of all water activities. Alcohol consumption is strictly prohibited for individuals under 18 years old in accordance with applicable Mexican laws. The use of illegal drugs or substances is strictly prohibited. Guests found in violation of this policy will be subject to immediate termination of the charter without a refund.
     

  • While we strive to adhere to the agreed-upon itinerary, the captain reserves the right to alter the route or make changes for safety reasons or unforeseen circumstances.

    COZUMEL WINDSEEKERS reserves the right to cancel a tour, and any such cancellation will be communicated to guests/agencies through email or phone prior to the scheduled tour. In the event of a tour cancellation, a full refund of any deposit paid by clients will be promptly processed.
    By booking our boat charter services, you acknowledge that you have read and agreed to these Terms and Conditions.

  • Before boarding, each passenger must read and sign a waiver form.

  • We recommend guests to plan ahead and arrive at least 20 minutes before the tour departure time. Timely arrival is crucial as we often have two back-to-back tours each day, and we need to start on time. If you arrive an hour late, you can still join the tour, but you will lose an hour of your scheduled time.

  • Our crew is highly qualified and luxury-trained. A minimum gratuity of 15% to 20% is expected if you are satisfied with the service. This gratuity can be paid in cash upon completion of your trip.

  • Liability Exemption:
    COZUMEL WINDSEEKERS, its affiliates, employees, and agents, collectively referred to as "the Company," are held completely harmless from any claims, demands, or liability arising from property damage, personal injury, or death related to the use of the boat, water accessories, and activities associated with the yacht during the charter service.

    Inherent Risks:
    Water activities inherently involve risks, including but not limited to accidents, injuries, and unforeseen events. Passengers voluntarily assume these risks when participating in the charter service.

    No Liability for Injuries:
    The Company assumes no liability for any injuries sustained by passengers during the charter service, including but not limited to slips, falls, collisions, or any other accidents.

    No Liability for Death:
    The Company is not liable for any unfortunate incidents resulting in the death of passengers during the charter service. Passengers acknowledge and accept the inherent risks associated with water activities.

    Exclusion of Claims:
    Passengers, by engaging in the charter service, expressly exclude any claims, demands, or legal actions against COZUMEL WINDSEEKERS for property damage, personal injury, or death sustained during the charter.

    Acceptance of Terms:
    By participating in the charter service, passengers explicitly acknowledge and accept the terms of this Accidental Damage, Death, and Injury Policy, releasing COZUMEL WINDSEEKERS from any and all liability associated with the mentioned risks.

    Legal Consideration:
    This policy is legally binding and constitutes an agreement between COZUMEL WINDSEEKERS and the passengers. Passengers are encouraged to carefully read and understand this policy before engaging in the charter service.
